  13. Shareware license agreement

  15. You are hereby licensed to evaluate the shareware version of CyberSky 
  16. for a period of 30 days, make as many copies of the software as you 
  17. wish, give copies of the software to anyone, and distribute the software 
  18. by electronic means and on physical media.

  20. You are specifically prohibited from charging for any such copies, 
  21. distributing the software in a modified form, distributing the software 
  22. with other products without prior permission, or using the electronic or 
  23. physical output of the software for any purpose other than evaluation of 
  24. the product.

  26. If you continue to use the shareware version of CyberSky after the 
  27. 30-day evaluation period, you are legally required to purchase the 
  28. registered version. Unregistered use of the shareware version of 
  29. CyberSky after the 30-day evaluation period is in violation of US and 
  30. international copyright laws.

  32. This license will terminate automatically if you fail to comply with the 
  33. limitations described above.

  38. USERS OF CYBERSKY MUST ACCEPT THE FOLLOWING DISCLAIMER OF WARRANTY. BY 
  39. USING THIS SOFTWARE YOU ARE CONSENTING TO BE BOUND BY AND ARE BECOMING A 
  40. PARTY TO THIS AGREEMENT.

  42. CYBERSKY IS SUPPLIED "AS IS". STEPHEN MICHAEL SCHIMPF DISCLAIMS ALL 
  43. WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE 
  44. WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR ANY PURPOSE. STEPHEN 
  45. MICHAEL SCHIMPF ASSUMES NO LIABILITY FOR DAMAGES, DIRECT OR 
  46. CONSEQUENTIAL, WHICH MAY RESULT FROM THE USE OF CYBERSKY.

  48. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR 
  49. OTHERWISE, SHALL STEPHEN MICHAEL SCHIMPF OR HIS SUPPLIERS OR RESELLERS 
  50. BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, 
  51. INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT 
  52. LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER 
  53. FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR 
  54. LOSSES.

  56. IN NO EVENT WILL STEPHEN MICHAEL SCHIMPF BE LIABLE FOR ANY DAMAGES IN 
  57. EXCESS OF STEPHEN MICHAEL SCHIMPF'S LIST PRICE FOR A LICENSE TO 
  58. CYBERSKY, EVEN IF STEPHEN MICHAEL SCHIMPF SHALL HAVE BEEN INFORMED OF 
  59. THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.

  61. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR
